- 1The contract sets the timetable — the settlement date and every condition deadline are written into it.
- 2Missing a condition deadline can cost you the right to terminate, so dates must be diarised from day one.
- 3Settlement in Queensland is completed electronically, with funds and title exchanged on the same day.
The steps in a Queensland conveyance
- ✓Contract signed and dated — the key dates start running.
- ✓Cooling-off period for residential buyers, where it applies.
- ✓Conditions period: finance approval, building and pest inspection and any special conditions.
- ✓Searches and enquiries: title, council, rates, and body corporate records for units.
- ✓Settlement preparation: the statement of adjustments, transfer documents and lender coordination.
- ✓Electronic settlement and registration of the transfer with Titles Queensland.
How long does conveyancing take?
The overall timeframe is set by the settlement date in the contract. For many residential purchases, settlement falls somewhere around 30 to 60 days after signing, but it can be shorter or longer by agreement — for example to allow for a longer finance period, or a seller who needs time to buy their next home.
Commercial, off-the-plan and rural transactions run on longer or more complex timetables. Your lawyer should confirm the timetable with you at the outset, in writing.
What a buyer's lawyer does
For buyers, the most valuable work happens before and just after signing: reviewing the contract, confirming the conditions protect you, and making sure notices are given correctly and on time. Before settlement we check the title, prepare the transfer documents, calculate adjustments for rates and other outgoings, and coordinate with your lender so funds are ready.
Transfer duty is payable on most property purchases in Queensland. We explain what applies and when, and whether any concessions may be available — the Queensland Revenue Office sets the rules.
What a seller's lawyer does
Sellers must give buyers the disclosure required by Queensland law before the contract is signed, so preparation starts before the property is listed. We then manage the buyer's conditions, release of any mortgage, the statement of adjustments and settlement, and confirm when the sale proceeds have been paid.
Common questions
Can I do my own conveyancing in Queensland?+
It is possible, but the contract, disclosure and notice requirements are technical and mistakes can be costly. Most buyers and sellers use a lawyer so that deadlines are managed and risks are identified early.
What happens on settlement day?+
Settlement happens electronically. Funds are exchanged and the transfer is lodged for registration at an agreed time, after which the keys are released to the buyer.
